The 112th Congress began on January 3, 2011 and runs until the mid or end of December 2012.

The RSOL of Virginia does NOT track, EVERY pending Bill related to Sex Offenders, Sexual Assaults, Abduction, Internet Safety, Adolescence Safety, Dating Violence, Human Trafficking or DNA Collection, Testing or Databases.

We track the bills that have serious unintended consequences, that include citizens that should not be included, that are questionably unconstitutional and that produce no positive purpose.

The RSOL of Virginia asks that you write, e-mail or call your one Congress member and our two Senators and ask them to oppose, amend or support these bills.

If you have family or friends in states that there is a sponsor or co-sponsor for one of these bills, please ask them to also write to their Congress member.

If we all do not speak up and speak out about these bills they will just pass through the system with a rubber stamp as they have in the past and then we will all suffer the consequences.


S124 – Safety for Our School Children Act 2011
A bill to require all public school employees and those employed in connection with a public school to receive FBI background checks prior to being hired, and for other purposes.

The term “Sexual Predator” has no real meaning; it’s used simply to sound tough. Any delivery driver or contractor that works for a company that makes deliveries to a school or that paints, works on plumbing, electrical, roofing, etc would be in violation of this law. But they wouldn’t even know it if they were sent to a school even when school is not in session.
If school districts want to implement a policy that no school employee can be a registered offender, fine!
But the Federal Legislators CAN NOT continue to limit employment and housing options for those who are labeled a sex offender in America. If constant, direct and unsupervised contact with minors is not part of the job description then that job should be available to anyone who is qualified to do it.

HR505 – Keep Kids Safe Act of 2011

Owning a gun and having a sex offense charge against a child have no correlation.
Our Legislators just want to take EVERYTHING away from those who are stigmatized Sex Offender and they keep giving bills like these titles that no one would EVER vote against.
They either need to try to take away guns from ALL citizens who have ANY type of misdemeanor conviction or just drop it!

This Bill is identical to HR4727 that Congressman Nadler filed back on March 2, 2010. HR4727 was never heard in sub-committee.

HR577 – Elder Abuse Prevention
To prevent the abuse and exploitation of older individuals.

First, the title of the bill, who wouldn’t vote for it?
Second, Congressman Chandler has again left the true intent of this bill out of its title.
HR577 is identical to HR1374 that Congressman Chandler filed back on March 6, 2009. HR1374 was never heard in sub-committee.
HR577 would prohibit parole for any individual who is convicted of a criminal sexual offense against a victim who is elderly which shall include any such offense under State law for conduct that would constitute an offense under chapter 109A of title 18, United States Code, had the conduct occurred in the special maritime and territorial jurisdiction of the United States or in a Federal prison or a Sexually Violent Predator.
Third, this bill does not define “Elderly” and it should.
Every Legislator and every State has their own definition of Sexually Violent Predator.

The RSOL of Virginia opposes the elimination of Parole as occurred in Virginia in 1995.

HR578 – No Parole for Sex Offenders Act
To ensure that sex offenders and sexually violent predators are not eligible for parole.

Every Legislator and every State has their own definition of Sexually Violent Predator so how can a Federal bill direct the States to eliminate Parole or lose 10% of their Byrne Grant, just like they’ve tried with the Adam Walsh Act 2006.

The RSOL of Virginia opposes the elimination of Parole as occurred in Virginia in 1995.

S329 - Safety from Sex Offenders Act of 2011
A bill to prohibit sex offenders from using property management or maintenance functions to access the residence of an individual.

Full Text

ANY registered offender who rents out their own property would be required to notify their renters in writing that they are a registered offender and that the renter acknowledges that the landlord has advised them of this and they hold a key to their property.
ANY registered offender already working for a property management company will most likely loose their job if this bill passes. NO property management company is going to ask for a signature from every tenant acknowledging that a registered offender has access to their apartment.
Another example of where one event, one example that results in a knee-jerk reaction to pass a Federal law.
Limiting employment opportunities for registered offenders and NO other group MUST stop.
If the Federal Legislators want to require this of registered sex offenders they should do it for ALL felony offenses.

SEC. 101. AUTHORITY TO RESTRICT PASSPORTS.

(a) In General- The Secretary of State is authorized to--

(1) limit to 1 year or such period of time as the Secretary of State shall determine appropriate the period of validity of a passport issued to a sex offender; and

(2) revoke the passport or passport card of an individual who has been convicted by a court of competent jurisdiction in a foreign country of a sex offense.

Not convicted of trafficking, but a sex offense. So again Congressman Smith and now all the Co-Sponsors are casting the net out as wide as they want while claiming the bill is for trafficking.

HR6196- Convicted Child Sex Offender DNA Index System Support Act
To eliminate the backlog in performing DNA analyses of DNA samples collected from convicted child sex offenders, and for other purposes.

The RSOL-VA does not oppose the numerous bills to eliminate the backlog of DNA samples/rape kits that untested evidence does need to be processed and any matches need to be made.
What we DO oppose is the title of this bill to add urgency and fear to the goal of processing the DNA kits. The sponsor of this bill unnecessarily stooped to the lowest level of public fear-mongering by inserting the words sex offender into this bill.
As of the 2008 General Assembly session, Virginia already gathers and files the DNA into a database of anyone convicted of a sexual offense.
