Irvin’s appeal was one of several put on hold while the Ohio Supreme Court awaited the decision in Stave v. Williams. In July, the court determined it was unconstitutional to retroactively apply the provisions of the Adam Walsh Act to offenders whose offenses pre-date the law’s enactment. In October, the court ruled Irvin’s classification should be done in accordance with Megan’s Law.
Under the Adam Walsh Act, offenders are ranked as Tier I, II, or III based solely upon the offense committed. Under Megan’s Law, offenders had a hearing in which the judge weighed a number of factors, including court testimony, statements at the classification hearing, history and the victims’ ages to determine whether they should be classified as a sexually oriented offender, habitual sex offender or sexual predator
