Convicted Sex Offender Cleared of New Charges in Bedford County (Virginia), October 5, 2012:
The Bedford County Sheriff’s Office says it was a case of mistaken identity.
Thursday morning they released a registered sex offender who had been charged with being at a school bus stop. Donald Dove was set free and cleared of all charges.
Dove had been arrested last week, after a 13-year-old girl told investigators a man had approached her at the bus stop in Evington last Wednesday and asked her to go home with him.
Investigators say numerous witnesses had identified Dove as that man. Then Thursday morning they got a call about a man walking near the same bus stop, and after talking to him, he admitted it had been him last week who had approached the girl. Major Ricky Gardner says the two men have similar descriptions.
Since this man is not a convicted sex offender, no crime took place, though deputies told him his actions were highly inappropriate.

Craig Evans had just finished typing out a solicitation for “skin on skin” sex with his unnamed girlfriend, when “a slip of the fingers” caused the message to be sent to everyone he knows — including two girls aged 13 and 14 who were in his swim class.
Unfortunately, while Lord Justice Elias acknowledged that Evans was “evidently misguided in the use of his BlackBerry,” he refused to erase the stain from his record completely, instead slapping him with a nine-month suspended sentence and a spot on the sex offenders list.
And all because, as one Daily Mail reader put it, “he’s got sausage fingers.” Sexters beware.

New Website Shows ‘Collateral Consequences’ of Criminal Convictions, September 20, 2012:
The American Bar Association and a Justice Department unit have launched a new website that allows users to search federal and state laws that hinder people with criminal records from being able to do basic things — like finding work and obtaining housing — to be able to reenter society successfully.
During remarks at the site’s launch yesterday on Capitol Hill, Senate Judiciary Committee Chairman Patrick Leahy (D-Vt.) noted how vital it is to understand what these “collateral consequences” can mean for those who have been convicted of crimes.
“Somebody may lose their right to vote, they may lose their right to hold certain licenses to practice a profession, sometimes even lose the right of where they can live,” Leahy said.

A man who gunned down two sex offenders on the Olympic Peninsula was sentenced Tuesday to life in prison without possibility of parole, but a judge warned those sympathetic to his cause to back off.
During sentencing Tuesday, the judge made it clear there should be no kind of vigilantism and told Drum’s supporters to back off from the attacks on the victims’ families. The wife of one of the victims says people who support Drum and consider him a “hero” have stalked their house, thrown things at their car, spat on them and more.

Obviously, criminals are not the most pitiable people so it’s hard to feel bad for a registered sex offender, but one measure of a developed society is how well it treats its most despicable members. An advanced society tries to put an end to the cycle of crime by rehabilitating criminals so they can atone for what they did and then get back to their lives. A less advanced society is content with punishing transgressors by casting them off into a life where crime is the only viable path.
Our commitment to justice is not tested with everyday thieves, but in the extremes of criminal activity. We don’t test our devotion to rehabilitation with the little old lady caught stealing a ham to feed her starving grandchildren. We test it with child molesters and rapists. We must be able to treat those individuals with fairness and attempt to rectify whatever made them act in a criminal way.
Of course, such an overhaul of our attitude toward crime won’t be easy. We are accustomed to harsh punishment to scare people into not being criminals. The goal instead should be to eliminate the conditions causing an individual to do something illegal. Crime prevention needs to stretch beyond the legal system. The best antidote for crime is more available jobs, not more police officers. And a judicial system concerned with getting criminals the help they need to avoid future crimes would benefit society the most.
Punishing criminals without giving them a chance to rectify their wrongs is inhumane and it should be illegal. It’s time we start acting as the advanced society we know we are.

The city of Franklin has dropped its legal fight to overturn a January court decision that found its ordinance restricting the residency of sex offenders unconstitutional. But the city will try other ways to keep sex offenders from living near schools, parks and other places children congregate, Mayor Ken Merrifield said.

A Durham man who is a registered sex offender pleaded guilty to being on school property but told the judge he was only there to pick up his stepdaughter when school let out early that day.
Griffin told Superior Court Judge Michael O’Foghludha that on that afternoon he was at home, in his work uniform and was just preparing to leave for work when his wife called him on the telephone.
She told him that her daughter’s school was letting out early that afternoon, and she couldn’t get off work to go pick her up. She asked if he could pick the girl up from school, Griffin said.
“As a husband and a father, that’s what I did,” he said.
Griffin told the judge that he thought his wife had called school officials and told them that he would be coming to the school to get his stepdaughter. After he was arrested, he found out his wife had not called the school to let them know he would be coming to the school.

A Louisville Sunday school teacher for 25 years, “W.B.” was appalled when he found out he might be listed on Kentucky’s Central Registry of substantiated child abusers because of an accusation for which he was never charged, says his lawyer, J. Fox DeMoisey.
W.B. feared that being listed would cost him his teaching post — and worse, his reputation, DeMoisey said. So W.B. skipped the normal appeals process and sued, saying he deserved to have his case heard by a jury.
A Jefferson Circuit Court judge and the Kentucky Court of Appeals ruled against him, saying that while the state should not “stigmatize the innocent,” it has an overriding interest in “keeping child abusers out of the ranks of child-care workers.”
Now, the state Supreme Court has agreed to hear oral arguments Sept. 12 in the case, deciding just how much due process individuals deserve before they are branded as abusers.

A federal appeals court said Indiana’s sex and violent offender registry unconstitutionally violated the due process rights of thousands of registrants because it did not give them a chance to fix mistakes.
Concluding that erroneous labeling as a “sexually violent predator” implicated a liberty interest protected by the Due Process Clause, the 7th Circuit noted that Indiana had recently begun letting current prisoners challenge pending registry listings, but gave other registrants no such opportunity.
“The policy provides no process whatsoever to an entire class of registrants — those who are not incarcerated,” and is therefore “constitutionally insufficient,” Circuit Judge Diane Wood wrote for a unanimous three-judge panel.

ACLU of Indiana Wins U.S. Court of Appeals Due Process Case, August 28, 2012:
Today the U.S. Court of Appeals for the Seventh Circuit reversed a U.S. District court ruling that had allowed the Indiana Department of Correction to operate a public sex offender database that failed to provide minimal procedures for those listed on the registry to challenge its accuracy. The Court called the process used by the DOC “constitutionally insufficient.”
“The Court found that the only way to guard against stigmatizing errors is to afford minimal due process,” said Ken Falk, Legal Director for the American Civil Liberties Union of Indiana, who argued the case before the Seventh Circuit.
The Court also observed that providing additional procedures to correct registry errors may benefit the state as well as registrants. “Erroneously labeling an offender a sexually violent predator imposes unnecessary monitoring costs on state law enforcement and reduces the efficacy of the registry in providing accurate information to the public,” the ruling said.

John Whitehead of The Rutherford Institute, a Virginia-based civil rights organization, rushed to Raub’s defense, filing multiple motions later denied, including a plea preventing Raub’s transfer away from family and legal counsel. Once denied, another appeal noting Raub’s initial detention orders did not follow the law Chesterfield PD was filed.
Judge Sharret agreed the arrest and detention actions were illegal and will request Raub’s discharge. As the Richmond-Times Dispatch reports, he was shocked by the failure of the magistrate to include in the order any grounds for holding Raub.
“The initial order was rubber-stamped”, says John Whitehead. “The special justice is very old. He had trouble hearing Brandon. He brought into the courtroom a personal cassette player – we tried to listen to it and you can hardly hear what’s being said. This is the so-called judge – he’s a lawyer, not a real judge – it’s like what you would see in a bad movie.”
“There’s a system here that is corrupt. And this guy is caught in it,” Whitehead told Business Insider. ”I’m friends with the local police; I could call them right now and probably get you committed if you were in Virginia. They can arrive at your door based on somebody’s testimony or your Facebook page and take you away to a mental hospital.”

New Cerritos Ordinance Bans Sex Offenders From City Parks, Libraries (CA), August 13, 2012:
Gary Berg, the city’s director of community and safety services, told the council Thursday that passing the ordinance isn’t going to prevent crime and enforcing it is problematic.
Nevertheless, the council passed the ordinance 4-1. Council members Jim Edwards, Bruce W. Barrows, Carol K. Chen and Mark E. Pulido voted in favor of the ordinance. Councilman Joseph Cho was the dissenting vote.
Councilman Cho asked Berg what information he had to justify supporting the ordinance, such as the number of child sex crimes committed at parks, how many children have been kidnapped in public places or if the parks or Civic Center are dangerous places.
“We have no information to suggest we have a problem in our parks,” Berg said.
He also said enforcement of the proposed ordinance is problematic.
