Church to Offer Worship for Sex Offenders (OK), April 29, 2011:
A local pastor who has conducted a prison ministry says his faith requires him to create a church service for former sex offenders.
Pastor Delbert Hawpe, pastor at For His Glory Church for 18 years, will begin adults-only services at 9 a.m. Sunday in Room B at the Muskogee Civic Center.
“I thought it was hypocritical for me to lead these men to Christ while they were incarcerated and yet not allow them to attend church when their sentence has been served,” Hawpe said. “To comply with the law and to be able to minister to these men, I decided to have separate services that are adults only, so there is no possibility of a parole violation either real or imagined.”
“All of us need love and forgiveness, and these guys were not getting it,” he said. “Christ died for sex offenders as well as for liars and adulterers.”
Being sincerely involved in a church is the best way for sex offenders to straighten out their lives, Hawpe said.
“Most of the sex offenders I have counseled with were molested when they were young and then became molesters,” he said. “The gospel is the only thing that will break this cycle. These men need to find forgiveness for their past, but Jesus is also interested in their future.”

N.J. Senate to Vote Thursday on Legislation to Allow Towns Restrict Where Sex Offenders Live, April 25, 2011:
The bill (S837), sponsored by state Sen. Fred Madden (D-Gloucester), would let towns keep moderate or high risk sex offenders from living within 500 feet of a school, playground or child care center.
School boards would also not be able to put a bus stop within 250 feet of a sex offender’s home.
Over 100 New Jersey towns used to have ordinances restricting where sex offenders could live. But they were struck down by a 2009 state Supreme Court decision that said the strict language of Megan’s Law bars them from enacting their own restrictions. Megan’s Law requires neighbors to be notified when a sex offender lives nearby, and allows parole officers to decide where the offenders live.

A federal appeals court on Wednesday affirmed a judge’s decision overturning a former sailor’s rape and murder convictions in the slaying of an 18-year-old woman in Norfolk.
A three-judge panel of the 4th U.S. Circuit Court of Appeals unanimously ruled that a defense attorney’s failure to try to suppress a confession violated Derek Tice‘s constitutional rights. Tice and three other sailors, known as the “Norfolk Four,” claimed after being convicted of the 1997 slaying of Michelle Moore-Bosko that their confessions were coerced.
Tice and two other members of the Norfolk Four were released from prison in 2009 after then-Gov. Tim Kaine granted conditional pardons. The fourth man had already been released after serving more than eight years in prison.
Kaine’s decision left the convictions intact, however, and Tice — who like the others was required to register as a sex offender — persisted in trying to clear his name. A few weeks after the governor’s action, U.S. District Judge Richard L. Williams overturned Tice’s conviction. The state attorney general’s office appealed, leading to Wednesday’s decision.
“We’re thrilled by the 4th Circuit’s decision,” said Desmond Hogan, one of Tice’s attorneys. “This is yet another rebuke to the commonwealth’s case against Derek and the other former servicemen who were wrongly charged and convicted.”
Tice’s father, Larry Tice of Clayton, N.C., had a similar reaction.
“We’re very happy for that decision, naturally but it just confirms what we’ve been saying all along — that Derek is innocent, and the others who make up the Norfolk Four are innocent, too,” he said.
The attorney general’s office was “disappointed but not surprised by the ruling,” spokesman Brian Gottstein said. He said no decision has been made on whether to appeal the decision.
Hogan said he hopes the state will not appeal, and that prosecutors will not seek to retry Tice.

But David and Gayle Fawcett believe that, in his own mind, their son’s life had ended a month earlier, when Justin’s probation officer told him he’d likely spend the next 25 years on Michigan’s public sex offender registry for a consensual relationship he’d had years earlier with a 14-year-old classmate at Bloomfield Hills’ Andover High School.
Last week, a little more than seven years after Justin Fawcett’s death, Gov. Rick Snyder signed into law a series of bills that will allow some teenagers prosecuted for their involvement in so-called Romeo and Juliet cases like Fawcett’s to escape the humiliating and life-stunting stigmatization that stalks those listed on Michigan’s sex offender registry.
The changes will place those convicted of committing sexual offenses when they were younger than 17 on a nonpublic list available only to police. They will also allow some older offenders — especially those who can satisfy the court that their underage sex partners were not coerced — to be removed from the list, or escape registration altogether.
Some of those who may benefit have already spent years on the public registry.

Should Murderers Have to Register as Sex Offenders Do? (IL), April 7, 2011:
Convicted killers who have served their time would have to reveal their addresses and even Facebook pages to the public under a bill the Illinois House approved Tuesday.
The bill, which passed 97 to 1 with four voting present, would establish a public registry for the nearly 500 people convicted of first-degree murder who were released from prison after at least 10 years.
The bill, now bound for the Senate, would place such convicts with child murderers, sex offenders and arsonists as people who have to submit their addresses to a state-operated registry.

Hurst, a Republican from Talladega, has proposed a bill that would require convicted child molesters to be surgically castrated under certain conditions. Specifically, the bill states that anyone more than 21 years old convicted of certain sex offenses against a child 12 years old or younger must be surgically castrated before being released from the state Department of Corrections.
Olivia Turner, executive director of the Alabama chapter of the American Civil Liberties Union, said in a Tuesday email to The Star that while Hurst’s intentions are good, he is going too far with his bill.
Turner said the castration bill is based on a false premise that sexual assault is the product of an uncontrollable sex drive.
“The reality is that sexual crimes are about violence, power and the humiliation of a survivor or victim, which is why a castrated sex offender can still be a serious danger,” Turner wrote. “The highest priority for members of the Legislature working to reduce repeat offenses by sex offenders should be an examination of the effectiveness and availability of psychological treatment for sex offenders in the custody of the Alabama Department of Corrections.”

Proposed Law Could Cause Sex Offender to Lose House, Family (IL), April 5, 2011:
Shane Sandborg is a sex offender under Illinois law because, when he was 17, less than five years separated him from his then 16-year-old pregnant fiance when they were having consensual sex.
Like any Dad, Shane Sandborg is there to help his son off the bus, but unlike most dads Shane has a real fear of losing his family.
“If law goes into play, now we have to worry if churches or office buildings or anything of that nature are too close to my residence now,” said Sandborg.
The law, which was introduced in mid-February, states no sex offender can knowingly live within 500 feet of a child counseling center. The Sandborgs are concerned the Silvis Heights Baptist church, a block and a half away from their home, could cause them to lose their home and each other.
“The law doesn’t specify what could be called a child counseling center,” said Sandborg, “It’s basically for local municipalities to decide.”

Nebraska Lawmakers Eye Rewrite of Sex Registry Law, April 4, 2011:
One amendment would remove designated low-risk offenders from the registry, if they committed the crime before a 2009 law took effect and if they have not reoffended.
The other amendment would return Nebraska to the system used prior to the 2009 law, which was enacted to align the state with federal law.
Judges would have the authority to decide whether an offender belongs on the registry, given the circumstances of the case.
