Should Child Porn Convicts be Required to Pay Restitution to Sex Victims? November 28, 2011:
The US Supreme Court declined on Monday to hear an appeal examining whether an individual convicted of possessing child pornography can be forced to pay potentially millions of dollars in restitution to a child victim identified in the seized images, even when he or she had no contact with the child.
The action leaves unresolved conflicting interpretations of a federal restitution statute.
At issue in the case was a law in which Congress directed the courts to order defendants who were convicted of crimes involving sexual exploitation of children to pay restitution to cover the “full amount of the victim’s losses.”
The law, known as Section 2259, has sparked disagreement within the federal judiciary over exactly what Congress meant by full restitution.

The irrationality is not confined to drug offenses. The share of federal sex offenders subject to mandatory minimums has risen dramatically in the last decade, from 5 percent in 2001 to 51 percent in 2010. And unlike drug offenders, they rarely qualify for lower sentences. Most sex offenders (72 percent in 2010) are charged with child pornography offenses, primarily (58 percent) possession only. The average sentence for child porn offenders subject to mandatory minimums is 11 years. “The Commission’s preliminary review of the available sentencing data suggests that the mandatory minimum penalties for certain non-contact child pornography offenses may be excessively severe and as a result are being applied inconsistently,” the report says. “The Commission is undertaking a more comprehensive study of child pornography offenses and expects to issue a report in the near future.”

Complying With Walsh Act Costs Ohio $10 Million, November 13, 2011:This summer an Ohio Supreme Court decision exposed the vulnerability of the more onerous requirement of the AWA. For the second time the Court found a portion of the AWA mandated legislation unconstitutional.
In State v. Williams, the Ohio Supreme Court held, “All sexual predators and most habitual sex offenders are expected, for the remainder of their lives, to register their residences and their employment with local sheriffs. Moreover, this information will be accessible to all. The stigma attached to sex offenders is significant, and the potential exists for ostracism and harassment.” Justice Paul E. Pfeiffer went on to write, “These restraints on liberty are the consequences of specific criminal convictions and should be recognized as part of the punishment that is imposed as a result of the offender’s actions.”
Retroactive laws
Justice Pfeiffer continued, “The General Assembly has the authority, indeed the obligation, to protect the public from sex offenders. It may not, however, consistent with the Ohio Constitution, ‘impose new or additional burdens, duties, obligations, or liabilities …’ We conclude … S.B. 10, violates Section 28, Article II of the Ohio Constitution, which prohibits the General Assembly from enacting retroactive laws.”
As the first state to comply with the AWA, Ohio’s problems with constitutionality are an ominous sign for other states. Amy Borror, spokeswoman for the Ohio Public Defenders Office, told the Pittsburgh Tribune-Review that complying with the AWA spawned more than 7,000 lawsuits and increased the workload on sheriff’s offices by about 60 percent. Her office estimates that Ohio has spent at least $10 million just on legal costs defending the AWA.

Media Chose the Wrong Penn State Story, November 12, 2011:
That media frenzy has long-since eclipsed reports of child rape involving Penn State football’s defensive coordinator, Jerry Sandusky. Instead, like a moth to the flame, the media has elevated Paterno’s involvement to preeminence. His lengthy career, his recent firing, and the outcry from an enraged fan base are the flaming results of this media-sponsored bonfire.
Let’s be clear. Paterno is not the issue here. In fact, given the shocking nature of these alleged acts, Paterno’s involvement is largely irrelevant.
Yes, there are indeed allegations of cover-ups. There are claims that many involved, including Paterno, could have done more to bring the matter to light. But blatant testimony currently points to only one individual, a person whose name is mentioned only as afterthought in most of the story coverage.
It is not Joe Paterno. That person is Jerry Sandusky.
The current media blitz is one of the more embarassing examples of journalists skewing the focus of a news story for the purpose of packaging a product. Let’s face it, if Jerry Sandusky were the head coach of a small college football program rather than the assistant to one of the sport’s most legendary figures, then the details may have never risen beyond the level of local news.

The university board has taken the approach of “cutting off the head of the snake”, firing Coach Paterno, presumably in the hopes that as with a snake, once the head is gone, the threat is gone. But is it that simple? Will that really make kids safer?? And if the argument is that it’s about the need to “make a statement” about the coach’s failure to act, why fire Paterno alone?
Why fire Paterno without also firing the graduate assistant, now coaching the team, who behaved exactly as his boss did – both passing the horrible news up the chain of university command, neither contacting the police or other authorities?
Because by firing Paterno and not even addressing the graduate assistant, those who heard the rumors that almost certainly were circulating as they always do around a locker room where very little can be kept secret, etc. the story can be put aside – an approach as old as sending the biblical Scapegoat off into the desert to carry away the community’s sins. But moral responsibility is more complicated than that. An honest accounting of the events surrounding Jerry Sandusky’s alleged serial abuse of children would require that we hold all people to an equal standard, and that can be uncomfortable.

A circuit court judge in Florida clearly thinks so: On Thursday, he sentenced Daniel Enrique Guevara Vilca, a 26-year-old stockroom worker whose home computer was found to contain hundreds of pornographic images of children, to life in prison without the possibility of parole.
But the severity of the justice meted out to Mr. Vilca, who had no previous criminal record, has led some criminal justice experts to question whether increasingly harsh penalties delivered in cases involving the viewing of pornography really fit the crime. Had Mr. Vilca actually molested a child, they note, he might well have received a lighter sentence.

Both CCA and GEO Group, the biggest players in the private-corrections-facility game, lobby directly to some of these agencies. In 2011, CCA spent $810,000 on lobbying agencies including the U.S. Marshals Service, which awards private-prison contracts, and the Bureau of Prisons. GEO Group spent $160,000 lobbying in 2011 -– it expanded its agency targets to ICE, the Department of Homeland Security (DHS) and the Department of Justice, according to Open Secrets.
Recently, GEO Group lobbied on a DHS budget bill, in particular on the issue report related to alternatives to detention for immigrants. CCA also lobbied on the bill, focusing on three issue reports about budgeting for federal agencies overseeing detention. The filings do not say the position of the companies.
